The invoice does not explain the source of the gold
Test the commercial story behind a precious-metals shipment. Learn why identifying the immediate seller may leave the true source unexplained.

What the official sources say
On 16 March 2018, DOJ announced that Elemetal LLC, doing business as Elemetal and NTR Metals, pleaded guilty to failing to maintain an adequate AML programme. The court accepted the plea in case 18-20173-CR-MORENO. [1]
DOJ’s account of the stipulated facts describes inadequate identification and source-of-gold enquiries, including for third parties and suppliers described as gold collectors. It also describes failure to follow up concerns about rotating front companies and possible cross-border smuggling. [1]
The announcement records proposed forfeiture and probation terms but says the corporate sentence would be determined later. [1]
This file is anchored to the accepted corporate plea announced in March 2018. It does not present proposed terms as a sentence imposed, conflate the corporate charge with separate employee convictions, or claim to establish the company’s current status.

Verify the story behind the intermediary
An invoice explains who billed the buyer. It may not explain who produced the gold, whether an intermediary had the capacity to obtain it or whether the stated source matches the shipment. Test the relationships instead of treating document presence as document reliability.
Cross-check trade and payment records
For a hypothetical shipment, compare the named seller, shipper, exporter, beneficiary and beneficial owners. Investigate material differences using corroborating records. A third-party payment can have a legitimate explanation, but that explanation needs evidence.
Write a proportionate recommendation
Set out the discrepancy, available explanations and evidence still required. Identify who can decide whether to proceed, pause or decline under policy and applicable law. Preserve the records supporting that decision and consider the relevant reporting framework.
What would you do next?
Fictional exercise: a refinery’s new customer proposes a large gold delivery. The invoice names a recently formed trading company; export papers name another company. Payment is requested to an unrelated beneficiary. The customer says it aggregates gold from small collectors but has not supplied a provenance trail. Commercial staff say the price is attractive.
