The documented case

What the official sources say

Historical event: 24 May 2016
Outcome at that date: Notice of intention to withdraw merchant-bank status
Jurisdiction: Singapore

MAS announced that it had served BSI Bank notice of intention to withdraw its merchant-bank status in Singapore for serious AML breaches, poor oversight and staff misconduct. [1]

MAS described unusual pass-through transactions with deficient documentation and reliance on client representations despite compliance concerns. It also described instructions taken from persons other than customers’ authorised representatives and referred six individuals for prosecutorial evaluation. [1]

The selected release describes a notice of intention and referrals. A referral is not a conviction. Do not treat the May announcement as a complete account of subsequent regulatory or individual proceedings.

What to learn from it

Separate familiarity from authority

An intermediary who knows the family or account is not automatically authorised to instruct it. Verify the mandate independently of commercial influence.

Read objections as decision evidence

A compliance concern should be resolved or escalated with reasons. A senior signature does not make missing evidence appear.

Make the decision traceable

Record the verified authority, economic explanation and evidence supporting approval. Preserve the rationale for exceptions and the identity of the authorised decision-maker.

Your decision · Fictional practice

What would you do next?

Fictional exercise: A prominent client’s adviser asks for an immediate pass-through transfer. The adviser is familiar to the relationship manager but is not on the mandate. Compliance has also queried the payment purpose. A senior manager offers to approve an exception.

Which requirement remains essential?

Compare your reasoning

Use this checklist to improve your answer. It is not an automatically marked essay.

  • Verify that the person giving instructions has the relevant authority.
  • Address outstanding purpose concerns separately from commercial pressure.
  • Record the exception rationale and escalation owner.

Take one lesson back to work

In your own environment: Verify that the person giving instructions has the relevant authority.
