When the customer profile stops explaining the account

A customer’s business label should explain the activity you observe. A mismatch needs investigation, not a convenient category change.

The documented case

What the official sources say

Historical event: 4 September 2018
Outcome at that date: Prosecutorial settlement accepted and paid
Jurisdiction: Netherlands

The Dutch Public Prosecution Service announced that ING accepted and paid a €775 million settlement, comprising a €675 million fine and €100 million disgorgement. Its account concerns structural AML failings in ING’s Netherlands business during 2010–2016. [1]

The prosecutor described inadequate customer due diligence, incorrect customer segmentation, insufficient monitoring and late or missing unusual-transaction reporting. It also described monitoring signals being limited in response to staff capacity. [1]

Read the outcome precisely

This is the 2018 prosecutorial settlement, not a trial judgment or a finding about every ING entity. Unusual-transaction reporting is the terminology used in this jurisdiction. The total is not all a fine or an estimate of money laundered.

Profile versus behaviour

A customer’s business label should explain the activity you observe. A mismatch needs investigation, not a convenient category change.

Follow the evidence

Compare expected turnover, customers, goods and payment routes with actual behaviour. Ask whether the bank is providing a service different from the one originally understood.

Change controls as well as labels

If a risk rating changes, identify the resulting due diligence and monitoring actions. Reclassification alone does not explain old transactions or remove the need to assess reporting.

Your decision · Fictional practice

What would you do next?

Fictional exercise: A company onboarded as a local building-materials seller now receives frequent overseas credits and makes large cash-related transfers. The relationship manager proposes changing the industry code to “general trading” to stop repeated alerts. No invoices or business-model explanation have been obtained.

Compare your reasoning

Use this checklist to improve your answer. It is not an automatically marked essay.

  • Check whether customer segmentation still matches observed business activity.
  • Corroborate the explanation using independent or reliable business records.
  • Document uncertainty and the consequence for controls and applicable reporting.
